1. Acceptance of Terms

These Terms of Service ("Terms") are a binding agreement between you and Atlantic Build Group ("Atlantic Build Group," "we," "us," or "our"), a construction firm based in Miami, Florida. By accessing or using atlanticbuildgroup.com (the "Site"), submitting a contact form, or using the AI estimator, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Site.

You must be at least 18 years of age and legally able to enter into a contract to use the Site or submit information through it.

2. Use of the Website

You agree to use the Site only for lawful purposes and only in ways that do not infringe the rights of, restrict, or inhibit anyone else's use of the Site. In particular, you agree not to:

  • Submit false, misleading, or fraudulent information through any form on the Site.
  • Attempt to gain unauthorized access to any portion of the Site, its server, or any related database.
  • Use any robot, spider, scraper, or other automated means to access the Site or extract data, except for public search-engine indexing.
  • Introduce any virus, worm, Trojan horse, or other malicious code.
  • Reverse engineer or attempt to extract the source code of any software included in the Site, including the AI estimator.
  • Use the Site or the AI estimator to compete with us, train a competing AI system, or aggregate pricing data for resale.

3. User Submissions

When you submit information to us through a contact form, the AI estimator, or any other means — including your name, contact details, project description, photos, or messages — you represent that the information is accurate, that you have the right to share it, and that doing so does not violate the rights of any third party.

You grant Atlantic Build Group a perpetual, non-exclusive, royalty-free license to use the information you submit for the purpose of responding to your inquiry, preparing an estimate or proposal, performing any work you engage us to perform, and improving our services. We will not publish your contact information or photos of your property publicly without your permission.

4. AI Estimator Disclaimer

Important — please read. The AI estimator on the Site provides a rough, computer-generated budget range based on the description you provide and typical South Florida market data. The output of the AI estimator is not a quote, an offer, a bid, an estimate by a licensed contractor, or a contract. No legal or binding obligation is created by either party as a result of generating or viewing an AI estimate.

You understand and agree that:

  • The estimator uses a third-party large language model (Claude, made by Anthropic) to interpret free-text project descriptions and produce an indicative range. Like any AI, it can be incomplete, inaccurate, or out of date.
  • The output is based solely on the description you typed and general assumptions about the South Florida construction market. It has no knowledge of your actual site, structural conditions, soil, hurricane code requirements, hidden conditions, finish-grade selections, HOA or city permitting requirements, or current material and labor pricing for your specific scope.
  • A real, binding price for any project can only be established after a site visit, scope review, and a written proposal or contract signed by an authorized representative of Atlantic Build Group.
  • You should not make any financial commitment, purchase, or contractual decision based on the output of the AI estimator alone.

5. No Project Pricing Guarantee

Construction pricing depends on many variables that the AI estimator does not capture, including site conditions, structural and mechanical requirements, permitting and inspection costs, supply-chain availability, code changes, weather delays, change orders, and the specific finishes you choose. Nothing on the Site — including the AI estimator, any budget range, any scope list, any blog or services description, or any photograph of past work — constitutes a guarantee, warranty, or representation that your project can be completed at any particular price or within any particular timeframe.

6. No Contract Formed Online

No contract for construction services is formed through the Site, by submitting a form, by using the AI estimator, or by exchanging emails or text messages. A binding agreement for construction services exists only after both you and an authorized representative of Atlantic Build Group execute a written contract that identifies the scope of work, contract sum, schedule, and other required terms in accordance with Florida law.

7. Intellectual Property

The Site and all of its content — including text, photographs, project images, logos, graphics, layout, source code, and the "Atlantic Build Group" name and trademarks — are owned by Atlantic Build Group or its licensors and are protected by U.S. and international intellectual property laws. You may view and print pages from the Site for your personal, non-commercial use. You may not copy, modify, republish, distribute, sell, or create derivative works from any portion of the Site without our prior written consent.

8. Third-Party Links & Services

The Site may link to or rely on third-party websites and services, including Google, Anthropic, our hosting provider, our SMS provider, and others. We do not control those third parties and are not responsible for their content, availability, or practices. Your use of any third-party website or service is governed by that party's terms and privacy policy.

9. Disclaimer of Warranties

The Site, the AI estimator, and all content on the Site are provided "as is" and "as available," without warranty of any kind, either express or implied. To the fullest extent permitted by law, Atlantic Build Group disclaims all warranties, including the implied warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, and title.

We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components, or that any output of the AI estimator is accurate, complete, or reliable. Your use of the Site is at your own risk.

This Section does not apply to, and does not limit, any warranties expressly provided in a written contract signed by Atlantic Build Group for actual construction work on your project.

10. Limitation of Liability

To the fullest extent permitted by Florida law, Atlantic Build Group, its owners, officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages — including lost profits, lost business, lost data, or cost of substitute services — arising out of or related to your use of the Site or the AI estimator, even if we have been advised of the possibility of such damages.

Our total cumulative liability arising out of or relating to the Site or the AI estimator is limited to one hundred U.S. dollars ($100.00).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. This Section does not limit our liability under any written construction contract you have signed with us — that contract governs our liability for actual work performed.

11. Indemnification

You agree to defend, indemnify, and hold harmless Atlantic Build Group and its owners, officers, employees, and affiliates from any claim, loss, damage, liability, or expense (including reasonable attorneys' fees) arising out of (a) your use of the Site in violation of these Terms, (b) any information you submit through the Site that infringes a third party's rights or is unlawful, or (c) your violation of any applicable law.

12. Governing Law & Venue

These Terms and any dispute arising out of or relating to them or to your use of the Site are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. You agree that the exclusive venue for any lawsuit arising out of or relating to these Terms or the Site shall be the state or federal courts located in Miami-Dade County, Florida, and you consent to the personal jurisdiction of those courts.

Nothing in this Section prevents either party from seeking equitable or injunctive relief in any court of competent jurisdiction.

13. Changes to These Terms

We may revise these Terms from time to time. The current version is always posted on this page, with the "Last updated" date at the top. Material changes will be highlighted on the Site for a reasonable period. Your continued use of the Site after a change takes effect means you accept the revised Terms.
